Privacy Policy

1. GENERAL PROVISIONS

1.1 This Privacy Policy governs the manner in which “MyChooz” (hereinafter referred to as “Site Administration”) uses and protects information collected from Users on the https://mychooz.com website (hereinafter referred to as “Site”). This privacy policy applies to the Site and all subdomains of the Site. The administration of the Site may collect user information of the following nature:

  • Cookies;
  • IP-address of the user;
  • Information about resource errors;
  • User behavior on the site, including the operating system and browser used.

1.2 All information is collected by the Site Administration as is and is not changed in the process of data collection.

1.3 The processing of information related to personal data is carried out in accordance with the terms of the Agreement on Personal Data Processing, the version of which is available at the following address: mychooz.com/personal_data.

1.4 At any time at its sole discretion, the Website Administration has the right to make changes to this Privacy Policy. Any revisions to this document will be published on the main page of the Site. To familiarize with any changes that may be made to this Privacy Policy, the User should periodically visit our Site.

1.5 Further use of the Site, means the User’s consent to any such changes to this Privacy Policy. In case of failure to agree with this Privacy Policy, the User has no right to use the Site.

1.6 This Privacy Policy applies only to the Site https://mychooz.com. The Site does not control and is not responsible for third party sites to which the User can go through the links available on the Site.

2. TERMS OF PERSONAL INFORMATION PROCESSING

2.1. The Site Administration may use its name, e-mail address, password to identify the User on mychooz.com, and may display its name, details, contact phone numbers, e-mail address, location address on the information resource mychooz.com.

2.2 The Website Administration may use the User’s contact information to process the company’s mailing list, namely to notify the User of new features, promotions and other news of the mychooz.com website. The User can always opt out of the newsletter processing.

2.3 The User’s personal information is kept confidential, except for cases when the User voluntarily provides information about himself/herself for public access to an unlimited number of persons. 3. TRANSFER OF PERSONAL INFORMATION OF USERS TO THIRD PARTIES

3.2.3 The transfer is provided for by Russian or other applicable law within the procedure established by law.

3.2.4. In case of sale of the Site, all obligations to comply with the terms of this Policy in relation to the personal information received by the acquirer shall be transferred to the acquirer.

4. MODIFICATION/DELETION OF INFORMATION OR REFUSAL FROM MAILING

4.1 Users may remove user information or unsubscribe from the mailing list at any time by sending such a request to [email protected]. Certain features of mychooz.com that require User information may be suspended from the time the information is deleted.

5. PROTECTION OF COLLECTED INFORMATION

5.1 The Website Administration takes all reasonable precautions to protect the confidentiality of data. 6. ADDITIONAL TERMS AND CONDITIONS

6.1 The Site Administration has the right to make changes to this Privacy Policy without the User’s consent.

6.2 The new Privacy Policy comes into effect from the moment of its posting on the Site, unless otherwise provided by the new version of the Privacy Policy.

6.3 The Site mychooz.com may contain links to other third party sites that may collect personal information about the User. In case of transfer to another site, the User leaves this Site, and the terms of this Privacy Policy will not apply to the User’s use of third-party sites and the User’s actions on them.

User Agreement

This User Agreement (hereinafter referred to as the “Agreement”) is designed to regulate relations between the Administration of the information resource “MyChooz” (hereinafter referred to as the “Administration”) and the User who searches for and distributes information on the resource located on the Internet at the address: mychooz.com (hereinafter referred to as the “Resource”).

1. GENERAL PROVISIONS

1.1 The use of materials and services of the Resource is regulated by the norms of the current legislation.

1.2 This Agreement is a public offer. By accessing the materials of the Website the User shall be deemed to have acceded to this Agreement.

1.3 The Administration has the right to unilaterally change the terms of this Agreement at any time. Such changes come into force from the moment of posting a new version of the Agreement on the Site. If the User does not agree with the changes made, he/she must refuse access to the Site, stop using the materials and services of the Site.

1.4 The mychooz.com Information Resource is a platform for posting information and is not a mass media.

1.5. The Administration of the Resource has contractual relations with the authors whose works and information are placed on the mychooz.com Information Resource.

1.6 The Administration does not edit the posted works of authors and information specified in paragraph 1.5 and is not responsible for its content.

1.7 By using the information posted on the Resource, the User understands and agrees that the Administration is not responsible for the content of the posted information. The authors of the information posted through the Resource independently represent and protect their interests arising in connection with the posting of this information in relations with third parties.

1.8 The Administration informs Users that the following information is not posted on the Resource:

aimed at war propaganda, incitement of national, racial or religious hatred and hostility;
not complying with the norms of morality and ethics;
violating the rights and protected interests of other persons;
other information the dissemination of which is prohibited.

1.9 The Administration reserves the right to remove any information posted on the Website without explanation.

1.10. Copyright and related personal property and non-property rights are respected and protected on the Resource. The use of works without the author’s consent is allowed only in cases established by law.

1.11. Any person who believes that his/her rights and legally protected interests are violated by the posted information specified in clause 1.5 has the right to file a claim directly with the author of such information.

2. SUBJECT OF THE AGREEMENT

2.1 The subject of this Agreement is to provide the User with access to the information contained in the Resource.

2.1.1 The Resource provides the User with the following types of services:

access to the search and navigation tools of the Resource;
providing the User with an opportunity to post messages, comments and ratings;
other types of services implemented on the Resource.

2.1.2 All existing (actually functioning) services of the Resource at the moment, as well as any subsequent modifications thereof and additional services of the Resource appearing in the future, shall be subject to this Agreement.

2.2 Access to the Resource is provided on a free of charge basis.

2.3 This Agreement is a public offer. By accessing the Resource, the User is deemed to have acceded to this Agreement.

2.4 The use of materials and services of the Resource is regulated by the norms of the current legislation.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1 The User has the right:

3.1.1. To freely search, receive, transfer, produce and distribute information on the Resource in any lawful manner;

3.1.2. Use all services available on the Resource;

3.1.3 Ask any questions related to the services of the Resource.

3.2 The Administration has the right:

3.2.1. At its own discretion, create, modify, cancel the Rules of Use of the Resource;

3.2.2 Unilaterally amend this Agreement;

3.2.3 Restrict access to the Website in case the User violates the terms of this Agreement.

3.3. Obligations of the User:

3.3.1 Observe the property and non-property rights of authors and other right holders when using the Resource.

3.3.2 Do not take actions that may be considered as disturbing the normal operation of the Resource.

3.3.3 Do not distribute any confidential information about individuals or legal entities protected by the laws of the Russian Federation using the Resource.

3.3.4 Avoid any actions that may violate the confidentiality of information protected by law.

3.3.5 Do not use the Resource to distribute information of an advertising nature, except with the consent of the Administration.

3.3.6. Do not use the services of the Resource for the purpose of:

downloading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, national, gender, religious, social grounds; contains inaccurate information and (or) insults to specific individuals, organizations, authorities;
inducement to commit unlawful acts, as well as assistance to persons whose actions are aimed at violating restrictions and prohibitions;
violating the rights of minors and (or) causing them harm in any form;
representing oneself as another person or representative of an organization and (or) community without sufficient rights to do so, including employees of this Resource.

3.4 The User is prohibited to:

Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the Resource.
Disrupt the proper functioning of the Resource.
Bypass the navigational structure of the Resource in any way to obtain or attempt to obtain any information, documents or materials by any means not specifically presented by the services of this Resource.
Unauthorized access to the features of the Resource, any other systems or networks related to this Resource, or any services offered on the Resource.
Breach the security or authentication system on the Resource or any network related to the Resource.
Reverse lookup, track or attempt to track any information about any other User of the Resource.
Use the Resource and its content for any purpose prohibited by law, or incite any illegal activity or other activity that violates the rights of the online store or others.
4. OTHER TERMS AND CONDITIONS

4.1 All possible disputes arising out of or related to this Agreement shall be resolved in accordance with applicable law.

4.2 Nothing in the Agreement may be understood as establishing between the User and the Administration agency relations, partnership relations, relations of joint activity, relations of personal employment, or any other relations not expressly provided for by the Agreement.

4.3 Recognition of any provision of the Agreement invalid does not entail invalidity of other provisions of the Agreement.

4.4 Inaction on the part of the Administration in case of violation of the provisions of the Agreement by any of the Users does not deprive the Administration of the right to take appropriate actions later in defense of its interests and protection of copyright to the materials of the Resource protected in accordance with the law.

4.5 The User realizes and agrees that the information posted by the User may be used by search or other automated services and other means.

4.6 The Administration is not responsible for any discrepancy between the services expected by the User and actually received.

4.7 In case of force majeure, i.e. extraordinary and unavoidable under the circumstances, the Administration does not guarantee the safety of the information posted by the User, as well as the uninterrupted operation of the Resource.

5. LIABILITY OF THE PARTIES

5.1 Any losses that the User may incur in case of intentional or negligent violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, the Administration shall not be reimbursed.

5.2 The Administration shall not be liable for:

5.2.1 Delays or failures in the process of making an operation, resulting from force majeure, as well as any case of malfunction in telecommunications, computer, electrical and other related systems.

5.2.2 Actions of transfer systems, banks, payment systems and for delays related to their work.

5.2.3. Information placed on the website provided for in clause 1.5 of this Agreement.

5.2.4. Proper functioning of the Resource, in case the User does not have the necessary technical means for its use, and does not bear any obligations to provide users with such means.

6. DISPUTE RESOLUTION

6.1 In case of any disagreements or disputes, a claim (a written offer of voluntary dispute resolution) is a mandatory condition before going to court.

6.2 Within 30 calendar days from the date of receipt of the claim, the recipient of the claim shall notify the claimant in writing of the results of consideration of the claim.

6.3 If it is impossible to resolve the dispute voluntarily, any of the Parties shall have the right to apply to the court for protection of their rights, which are granted to them by the current legislation.

6.4 Any claim with respect to the terms of use of the Resource must be filed within 14 calendar days after the grounds for the claim arise, except for the protection of copyrights for the materials of the Resource protected in accordance with the legislation. If the terms of this clause are breached, any claim or cause of action shall be barred by the statute of limitations.

7. ADDITIONAL TERMS AND CONDITIONS

7.1 The Administration does not accept counter-proposals from the User regarding changes to this User Agreement.

7.2 User’s feedback posted on the Resource is not confidential information and can be used by the Administration without restrictions.

Personal Data

It is an integral part of the User Agreement, the current version of which is available at the following address: mychooz.com/agreement .

  1. The User, by accepting this Agreement on Processing of Personal Data (hereinafter – “Agreement”), gives his/her consent in accordance with the Act “On Personal Data” (hereinafter – “On Personal Data”) to the processing of his/her personal data (PD), namely: surname, name, patronymic; electronic mail (e-mail); telephone number.
  2. The operator of the processing of the User’s personal data is the administration of the information resource “MyChooz” (hereinafter – “Site Administration”), located at the domain name mychooz.com (hereinafter – “Resource”).
  3. The processing of the above-mentioned personal data is carried out through the mixed processing of personal data (collection, systematization, accumulation, storage, updating, modification, use, distribution, including communication, depersonalization, blocking, destruction or deletion).
  4. The processing of personal data is carried out for an indefinite period.
    Deletion of personal data from the system at the request of the User is possible if this request is executed in accordance with the requirements of the Law “On Personal Data” and sent from the

The User understands and agrees that by submitting a request for deletion of personal data from the system to the Administration, the User simultaneously authorizes the Administration to delete his/her account created by the Administration at the time of his/her registration on the Website.
  6. The purpose of the processing of personal data is the use of the Resource and its services, as well as services integrated with the Resource.
  7. The User also confirms that the personal data provided by him/her are correct and expresses his/her full and unconditional consent (acceptance) to the use of his/her contact data for communication purposes, to make phone calls to the specified landline and/or mobile phone, to send SMS messages to the specified mobile phone, to send e-mails to the specified e-mail address, to confirm the data necessary for the operation of the Resource and/or its individual services, as well as for the purposes established by the Administration of the Website Administration. The Site Administration’s feedback to the User is not tied to any particular method, including, but not limited to, those specified in the above actions.
  8. The User also provides the Site Administration with access to the following technical information: cookies, browser sessions, User’s IP address.
